White Collar Crimes: State and federal

Financial crimes, or white collar crimes, are investigations and charges based off of financially motivated, nonviolent, actions taken by individuals or government officials. These cases are typically investigated and prosecuted by state authorities or federal authorities. However, there are instances where both are involved. The biggest mistake is to delay or procrastinate hiring a criminal defense attorney. More often than not criminal prosecution can be avoided if counsel is involved the instant there appears to be a problem.

On the federal level, the first time someone is aware of a problem is when there are agents at the door with a search warrant. The best thing you can do is cooperate, SAY ABSOLUTELY NOTHING, and call criminal defense counsel. If possible, Attorney Molfetta will come to the scene and talk with the investigators. Oftentimes he is able to get a leg up on what the issues are and how to proceed strategically. If arrests are going to be in effect, he is usually able to coordinate it, so it is not intrusive.

White collar cases are document intensive and usually very complicated. Michael Molfetta is one of the best in the industry when it comes to handling these cases and strategically planning the defense. Attorney Molfetta knows how to navigate these waters and get his clients back to their daily lives.

The instant you realize there is a serious problem at hand, call Molfetta Law. There is no stigmatization because “criminal defense counsel” is involved. It is smart to hire an attorney to protect you by fighting your legal battle.

Narcotics and drug related offenses: state and federal

Narcotics also known as “opioids” were originally referred to as a variety of substances that dull the senses and relieve pain. Today narcotics is synonymous with the term “opiods” and refers to opium, opium derivatives and their semi-synthetic substitutes. Opioids also include heroin and pharmaceutical drugs such as OxyContin, Vicodin, codeine, morphine, methadone and fentanyl.

The most common cause of opioid addiction is due to pain management following an injury or surgery that eventually leads to addiction and acquiring medication through illegal means.

State and federal drug crimes both prohibit the manufacture, possession, and sale of controlled substances. “Controlled substances” means the use and distribution of substances is governed by state or federal law.

The federal government has its own strategy to combat the use, abuse and distribution of controlled substances. Each state also has its own laws that pertain to the use, manufacture and distribution of drugs. Federal drug crimes usually carry harsher punishments and longer jail sentences and are often charged as felonies. Most states that charge for possession without the intent to distribute can be charged as felonies or misdemeanors and usually have a lighter sentence. The most common drugs associated with crimes are marijuana, methamphetamine, ecstasy, cocaine and heroin.

Drug related offenses are among the most common crimes in the United States. Most drug offenses result in felonies and will remain on your permanent record. Penalties for drug related crimes can be severe. The charges are based upon numerous factors such as the intent to sell or distribute, and other factors like possession or use of weapons.

It is imperative to hire an attorney that specializes in drug offenses as jail time is a distinct consequence without proper legal representation.

Murder And Manslaughter

Murder is the unlawful killing of another human being with intent (or malice aforethought) to kill another person. Generally this state of mind distinguishes murder from other forms of unlawful homicide, such as manslaughter. Typically the punishment for murder is life in prison. Either 15 years to life (which means the client gets their first parole hearing after approximately 13 years), 25 years to life (first parole hearing after approximately 23 years), life without the possibility of parole (A.K.A. LWOP), or the death penalty.

Murder cases are high stakes, high stress cases. The prosecutors and the detectives are always the best that law enforcement has to offer. It is absolutely imperative to get an experienced defense attorney retained and working the minute a person becomes a suspect. Throughout Michael Molfetta’s career he has handled over 75 murder cases. Almost all of those have been “special circumstances” cases, which is to say, the death penalty was a possible outcome.

The vast majority of people who are convicted of murder contribute to their own demise because of their actions between the incident itself and any arrest. More often than not these actions provide detectives and prosecutors with circumstantial evidence that is crucial to securing convictions.

The instant it is even remotely possible that you or a loved one is, or is about to be, a suspect of a homicide it is critical to get legal counsel in place.

Sex Offenses

Similar to drug related crimes, there are many different types of sex related crimes. Most criminal sexual misconduct falls within the jurisdiction of state law like rape, sexual assault, or molestation. Federal sexual offenses focus on offenses involving children, production of prohibited pornography, and interstate travel for the purpose of prohibited sexual activity. It also includes the transportation of individuals for the use in prostitution or other illegal sexual activity, most commonly known as sex trafficking.

There are many different circumstances that decide the severity of the penalties and sentences. Not all sexual offense crimes are considered equal, many of the crimes require “registration” requirements of the offender which can in return make it difficult for someone to live a normal life. This is why it is imperative to hire a criminal defense attorney from the very beginning, especially if you are falsely accused.

Consumer Protection Advocates

Consumer protection is the practice of protecting buyers of goods and services, and the public, against unfair practices in the marketplace. These measures are protected by law. Whether it is a service that requires a contractual agreement or an unfair purchase, Michael Molfetta will make sure you are protected by current consumer laws.

Timeshare Exits

Timeshares are notoriously bad investments— the resorts are chronically overbooked, oversold and the buyer owns essentially nothing. Many resorts use high pressure sales tactics to lure consumers into a lifetime contract with stretched truths and gift offerings. When a consumer signs their contract they are unaware of the continuous and rapid rise of  maintenance fees, how often they can make use of it, and in various cases, what their timeshare will actually be like. The client believes they are making a good investment, when in reality many have signed their lives away for negligible value.

At Molfetta Law, we help our clients cancel their timeshare contracts freeing themselves of onerous  financial burdens for good. Each client has a team of established advisors & advocates that specialize in helping dissatisfied timeshare owners terminate their contracts.

Molfetta Law encourages you to reach out to your resort first if your circumstances have changed and you are no longer in need of your timeshare. We acknowledge it’s possible to negotiate a cancellation of your timeshare and encourage you to try it yourself. Molfetta Law will work with clients that have acknowledged they have made considerable efforts to cancel their contract by themselves with their own free will of signing up with an exit company.

We pride ourselves on impeccable customer service. One way we have achieved this is by creating a custom, automated system that allows our clients to easily access their files, check for updates, and receive real time communication from the firm 24/7.
